You and the Owner agree that any dispute, claim, or controversy arising out of or relating to this Privacy Policy or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration on an individual basis in accordance with this arbitration provision. You acknowledge and agree that you are waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.
13.2 Arbitration Rules and Forum
The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with the AAA's Consumer Arbitration Rules then in effect, except as modified by this Privacy Policy. The arbitration will be conducted in the English language. The arbitration shall be conducted by a single, neutral arbitrator selected in accordance with the AAA's rules.
13.3 Arbitration Location and Procedure
Unless you and the Owner otherwise agree, the arbitration will be conducted in Texas. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA rules.
13.4 Arbitrator's Decision
The arbitrator will render an award within the time frame specified in the AAA rules. The arbitrator's decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. 13.5 Fees
Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules. YOU AND THE OWNER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Further, unless both you and the Owner agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding.
13.7 Opt-Out Right
You have the right to opt out of this agreement to arbitrate by sending written notice of your decision to opt out to the Owner at the address listed in the "Contact Us" section below. Your notice must include your name and address, the email address you used to set up your account (if you have one), and a clear statement that you want to opt out of this arbitration agreement. If you opt out of this arbitration provision, all other parts of this Privacy Policy will continue to apply to you.
13.8 Exceptions
Notwithstanding the foregoing, either you or the Owner may bring an individual action in small claims court. Furthermore, claims of defamation, violation of the Computer Fraud and Abuse Act, and infringement or misappropriation of the other party's patent, copyright, trademark, or trade secrets shall not be subject to this arbitration agreement. In addition, nothing in this arbitration agreement shall prevent either party from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
